न्यायिक पृथक्करण (Judicaial Saperation) धारा 10 और 13 (1A)
विवाह का एक महत्वपूर्ण पक्ष यह होता है कि विवाह के दोनों पक्ष मिल कर दाम्पत्य अधिकारों और कर्तव्यों का निर्वहन करें जिसका अर्थ है दोनों साथ रहें। यह साहचर्य विवाह की अवधारणा में ही सम्मिलित है। लेकिन कभी-कभी ऐसी परिस्थितियाँ भी उत्पन्न हो सकती हैं जब दोनों साथ रहना नहीं चाहें। ऐसी स्थिति में दोनों पारस्परिक सम्मति से अलग रहने के लिए समझौता कर सकते हैं बशर्ते कि ऐसा समझौता वर्तमान से संबंधित हो न कि भविष्य से। हिन्दू विवाह अधिनियम की धारा 10 उन्हें न्यायालय की डिक्री द्वारा अलग रहने अर्थात् न्यायिक पृथक्करण का अधिकार देता है।
तलाक से भिन्न न्यायिक पृथक्करण में वैवाहिक संबंध बने रहते हैं केवल कुछ वैवाहिक कर्तव्य और अधिकार निलम्बित हो जातें हैं। इसलिए न्यायिक पृथक्करण की डिक्री के बाद भी किसी पक्ष को दूसरा विवाह करने का अधिकार नहीं होता है। एक पक्ष की मृत्यु पर दूसरे को उसके संपत्ति पर उत्तराधिकार बना रहता है। भरण-पोषण का अधिकार भी बना रहता है बशर्ते की दोनों के बीच ऐसा कोई समझौता न हो जिसके अनुसार यह अधिकार छोड़ दिया गया हो। लेकिन यदि उनके बीच यह समझौता हो कि दोनों में से कोई दाम्पत्य अधिकारों के प्रत्यास्थापन या अपत्यों के भरण-पोषण एवं अभिरक्षा की माँग नहीं करेंगे और इस शर्त का उल्लंघन कर कोई एक पक्ष ऐसे डिक्री के लिए याचिका प्रेषित करे तो न्यायालय ऐसी शर्तों को मानने के लिए बाध्य नहीं है।
पृथक्करण की स्थिति में भरण-पोषण के अधिकार से संबंधित प्रावधान हिन्दू विवाह अधिनियम में हिन्दू दत्तक और भरण-पोषण अधिनियम से भिन्न है।

| 1 | इस धारा के तहत कुछ आधारों के होने पर हिन्दू पत्नी पति से पृथक रह सकती है और पति से भरण-पोषण की माँग कर सकती है। लेकिन उस विशेष आधार के समाप्त होते ही वह पति के साथ दाम्पत्य जीवन का पुनरूस्थापन करने के लिए बाध्य है। उदाहरण के लिए धारा 18 (2) के तहत पत्नी पति से इसलिए अलग रह रही हो कि पति ने दूसरा विवाह कर लिया हो तो ऐसी स्थिति में अगर दूसरी पत्नी की मृत्यु हो जाए या उससे पति तलाक ले ले तो पत्नी के पास अलग रहने का अधिकार समाप्त हो जाएगा और उसे पति के साथ दाम्पत्य जीवन पुनः शुरू करना होगा अन्यथा पति उसे भरण-पोषण देने के लिए बाध्य नहीं है। | इसके तहत न्यायिक पृथक्करण की डिक्री अगर पारित हो जाए तो पक्षकार एक-दूसरे के साथ रहने के लिए तब तक बाध्य नहीं होते हैं जब तक कि डिक्री निरस्त नहीं कर दी जाए। |
| 2 | इसके अन्तर्गत पृथक्करण वैयक्तिक है और पत्नी जब चाहे पुनः पति के साथ दाम्पत्य जीवन स्थापित कर सकती है। | इसमें पक्षकार को डिक्री को निरस्त करने के लिए न्यायालय में याचिका देना होता है और न्यायालय को ही अधिकार है कि वह डिक्री को निरस्त करे। |
| 3 | न्यायालय को अपत्यों की अभिरक्षा और भरण-पोषण के लिए की डिक्री पारित करने की अधिकारिता इस धारा के अन्तर्गत नहीं है। | न्यायिक पृथक्करण की कार्यवाही में और डिक्री पारित होने के पश्चात् भी न्यायालय को पक्षकारों के भरण.पोषण और अपत्यों के सम्बन्ध में अभिरक्षा और भरण-पोषण की डिक्री पारित करने की अधिकारिता है। |
| 4 | इसके अन्तर्गत पृथक्करण विवाह-विच्छेद के लिए आधार नहीं प्रदान करता है। | न्यायिक पृथक्करण की डिक्री पारित होने के एक वर्ष या उससे अधिक समय तक यदि दाम्पत्य अधिकारों का पुनर्स्थापना नहीं हो सके तो इस आधार पर पक्षकार विवाह-विच्छेद की डिक्री के लिए याचिका प्रेषित कर सकते हैं । |
न्यायालय न्यायिक पृथक्करण की डिक्री के लिए याचिका तभी स्वीकार करेगा जब कि विवाह विधि मान्य हो। लेकिन अगर स्वेच्छा से पृथक्करण के समझौते के समय पक्षकारों को विश्वास था कि उनका विवाह विधिमान्य है लेकिन बाद में उन्हें पता चले कि उनका विवाह शून्य है तो ऐसे समझौते को विघटित कराया जा सकता है। परन्तु यदि उन्हें पता चलता है कि विवाह शून्यकरणीय है तो समझौते को विघटित नहीं कराया जा सकता है।
न्यायिक पृथक्करण के डिक्री के लिए याचिका किसी आधार पर ही प्रेषित किया जा सकता है। ऐसे आधार विवाह विच्छेद के समान या पृथक हो सकते हैं। विशेष विवाह अधिनियम, 1954 की धारा 18 के अनुसार पति और पत्नी दोनों के लिए आधार एक ही हैं। 1976 के संशोधन के बाद हिन्दू विवाह अधिनियम में भी दोनों के लिए अधिकांश आधार समान कर दिए गए हैं।
कोई भी पक्षकार न्यायिक पृथक्करण की याचिका निम्नलिखित में से किसी भी आधार पर प्रस्तुत कर सकता है-
- 1. व्यभिचारित का आचरण
- 2. क्रूरता
- 3. अभित्यजन
- 4. धर्मपरिवर्तन
- 5. विकृतचित्तता
- 6. कोढ़
- 7. संचारी रतिजन्य रोग
- 8. संन्यासी होना
- 9. सात वर्ष से लापता होना
निम्नलिखित आधार केवल पत्नी को प्राप्त है- [धारा 13 (2)]
- 10. पति द्वारा दूसरा विवाह करने पर
- 11. पति के बलात्संग या अप्राकृत मैथुन के दोषी होने पर
- 12. भरण-पोषण की डिक्री नही तामिल होने पर
- 13. यौवनावस्था का विकल्प (option of puberty)
न्यायिक पृथक्करण का अंत या तो दोनों पक्षकारों में पुनः साहचर्य स्थापित हो जाने से होता है या विवाह-विच्छेद से। पक्षकार चाहे तो जीवनभर ऐसे ही न्यायिक पृथक्करण में भी रह सकते हैं। अगर दोनों पक्षकार स्वेच्छा से पृथक् रह रहे हो तो इसका अंत तभी हो जाएगा जब कि दोनों साथ रहना शुरू कर दे।
अगर न्यायिक पृथक्करण हो तो जो पक्षकार पुनः दाम्पत्य जीवन शुरू करना चाहता हो वह न्यायालय में न्यायिक पृथक्करण को रद्द करने के लिए के लिए याचिका प्रेषित कर सकता है। न्यायालय सामान्यतः यह डिक्री रद्द कर देता है लेकिन पक्षकार चाहे तो डिक्री के एक वर्ष या अधिक अवधि तक अगर दाम्पत्य संबंधों की प्रत्यास्थापन नहीं हो पाए तो धारा 13 (1) (i) के अंन्तर्गत विवाह-विच्छेद के लिए याचिका दायर कर सकता है। चन्दर विरूद्ध सुदेश मामले में जनवरी, 1966 को विवाह-विच्छेद के लिए याचिका दायर की गई जब तक कि विवाह हुए दो वर्ष की अवधि पूर्ण नहीं हुआ था। (1976 के संशोधन से पहले विवाह-विच्छेद की याचिका विवाह के दो वर्ष के बाद ही प्रेषित की जा सकती थी संशोधन के बाद यह अवधि अब एक वर्ष कर दी गई है।) जिला न्यायालय ने 25.09.1967 को विवाह-विच्छेद की डिक्री को न्यायिक पृथक्करण की डिक्री में बदल दिया क्योंकि उनके अनुसार विवाह-विच्छेद की आधार पूर्णतया सिद्ध नहीं हुआ था। लेटर पेटेण्ट अपील (LPA) होने पर न्यायालय ने कहा कि अपीलीय न्यायालय की डिक्री उस दिन से मान्य होगी जिस दिन से जिला न्यायालय ने डिक्री पारित की थी। इस अपील की तिथि तक दो वर्ष पूरा हो गया था।
अतः दिल्ली उच्च न्यायालय ने कहा कि हिन्दू विवाह अधिनियम के अन्तर्गत विवाह-विच्छेद की डिक्री पारित कर सकते हैं और ऐसी डिक्री पारित कर दी गई। अर्थात् न्यायालय ने विवाह-विच्छेद की डिक्री उस आधार पर पारित की जो याचिका प्रेषित करते समय विद्यमान ही नहीं था। 1976 के संशोधन द्वारा इस अवधि को एक वर्ष कर दिया गया। साथ ही न्यायिक पृथक्करण और विवाह-विच्छेद के लिए आधारों को एक कर दिया गया। लेकिन धारा 13 (क) में इसके कुछ अपवाद भी दिए गए हैं। ये अपवाद हैं- धर्म परिवर्तनए संसार-त्याग और मृत्यु की उपधारणा। इन तीन आधारों पर विवाह-विच्छेद की याचिका प्रेषित करने पर न्यायालय यदि सही समझे तो विवाह-विच्छेद के बजाय न्यायिक पृथक्करण की डिक्री पारित कर सकती है।
