131. विद्रोह का दुष्प्रेरण या किसी सैनिक, नौ सैनिक, नौ सैनिक या वायु सैनिक को कर्तव्य से विचलित करने का प्रयत्न करना– जो कोई भारत सरकार की सेना, नौ सेना या वायु सेना के किसी ऑफिसर, सैनिक, नौसैनिक या वायु सैनिक द्वारा विद्रोह किए जाने का दुष्प्रेरण करेगा या किसी ऐसे ऑफिसर, सैनिक, नौ सैनिक या वायु सैनिक को उसकी राज्य निष्ठा या उसके कर्तव्य से विचलित करने का प्रयत्न करेगा, वह आजीवन कारावास से या दोनों में से किसी भाँति के कारावास से, जिसकी अवधि दस वर्ष तक की हो सकेगी, दण्डित किया जाएगा और जुर्माने से भी दण्डनीय होगा।

स्पष्टीकरण- इस धारा में “ऑफिसर”, “सैनिक”, “नौ सैनिक” “वायु सैनिक”, शब्दों के अन्तर्गत कोई भी व्यक्ति आता है जो यथास्थिति आर्मी एक्ट [सेना अधिनियम, 1950 (1950 का 46), नेवल डिसिप्लिन एक्ट, इंडियन नेवी (डिसिप्लिन) एक्ट, 1934 (1934 का 34), एयर फोर्स एक्ट या वायु सेना अधिनियम, 1950 (1950 का 45) के अध्यधीन हो।

[इस धारा के तहत अपराध गठित होने के लिए निम्नलिखित अनिवार्य तत्त्व हैं- अभियुक्त ने भारत सरकार के सैनिक, नौसैनिक या वायु सैनिक को:

(1) विद्रोह के लिए दुष्प्रेरित किया हो, या

(2) उसको राज्यनिष्ठा या कर्तव्य से विचलित करने का प्रयत्न किया हो,

132. विद्रोह का दुष्प्रेरण यदि उसके परिणामस्वरूप विद्रोह किया जाए– जो कोई भारत सरकार की सेना, नौ सेना या वायु सेना के किसी ऑफिसर, सैनिक, नौ सैनिक या वायु सैनिक द्वारा विद्रोह किए जाने का दुष्प्रेरण करेगा यदि उस दुष्प्रेरण के परिणामस्वरूप विद्रोह हो जाए, तो वह मृत्यु से या आजीवन कारावास से, या दोनों में  से किसी भाँति के कारावास से, जिसकी अवधि दस वर्ष तक की हो सकेगी, दण्डित किया जाएगा और जुर्माने से भी, दण्डनीय होगा।

[इस धारा के तहत अपराध गठित होने के लिए निम्नलिखित अनिवार्य तत्त्व हैं:

(1) अभियुक्त विद्रोह के लिए दुष्प्रेरण करेगा;

(2) ऐसा दुष्प्रेरण भारत सरकार के सैनिकए नौसैनिक या वायुसैनिक को किया जाएगा;

(3) इस दुष्प्रेरण के परिणामस्वरूप विद्रोह हुआ हो।]

133. सैनिक, नौ सैनिक या वायु सैनिक द्वारा अपने वरिष्ठ ऑफिसर पर जबकि वह ऑफिसर अपने पद-निष्पादन में हो, हमले का दुष्प्रेरण- जो कोई भारत सरकार की सेना, नौ सेना या वायु सेना के किसी ऑफिसर, सैनिक, नौ सैनिक या वायु सैनिक द्वारा किसी वरिष्ठ ऑफिसर पर जबकि वह ऑफिसर अपने पद­निष्पादन में हो, हमले का दुष्प्रेरण करेगा, वह दोनों में से किसी भाँति के कारावास से जिसकी अवधि तीन वर्ष तक की हो सकेगी दण्डित किया जाएगा और जुर्माने से भीए दण्डनीय होगा।

[इस धारा के तहत अपराध गठित होने के लिए निम्नलिखित अनिवार्य तत्त्व हैं-

134. ऐसे हमले का दुष्प्रेरणए यदि हमला किया जाए- जो कोई भारत सरकार की सेनाए नौ सेना या वायु सेना के ऑफिसर, सैनिक, नौ सैनिक या वायु सैनिक द्वारा किसी वरिष्ठ ऑफिसर पर, जबकि वह ऑफिसर अपने पद­निष्पादन में हो, हमले का दुष्प्रेरण करेगा, यदि ऐसा हमला उस दुष्प्रेरण के परिणामस्वरूप किया जाए, तो वह दोनों में से किसी भाँति के कारावास से, जिसकी अवधि सात वर्ष तक की हो सकेगी, दण्डित किया जाएगा और जुर्माने से भी दण्डनीय होगा।

[इस धारा के तहत अपराध गठित होने के लिए निम्नलिखित अनिवार्य तत्त्व हैं:

  • अभियुक्त ने भारत सरकार के किसी सैनिकए नौसैनिक या वायुसैनिक को दुष्प्रेरित किया हो;
  • ऐसा दुष्प्रेरण किसी किसी वरिष्ठ अधिकारी के विरूद्ध हो;
  • वह वरिष्ठ अधिकारी अपने पद­निष्पादन में हो। और
  • ऐसे दुष्प्रेरण के परिणामस्वरूप हमला किया गया हो।]

 135. सैनिक, नौ सैनिक या वायु सैनिक द्वारा अभित्यजन का दुष्प्रेरण- जो कोई भारत सरकार की सेनाए नौ सेना या वायु सेना के किसी ऑफिसर, सैनिक या नौ सैनिक या वायु सैनिक द्वारा अभित्यजन किए जाने का दुष्प्रेरण करेगा, वह दोनों में से किसी भाँति के कारावास से जिसकी अवधि दो वर्ष तक की हो सकेगी, या जुर्माने से, या दोनों से, दण्डित किया जाएगा।

    [इस धारा के तहत अपराध गठित होने के लिए निम्नलिखित अनिवार्य तत्त्व हैं:

  • अभियुक्त अभित्यजन के लिए दुष्प्रेरण करे;
  • ऐसा दुष्प्रेरण भारत सरकार कि किसी सैनिक, नौसैनिक या वायु सैनिक का करे।]

136. अभित्यजन को संश्रय देना– जो कोई सिवाय एतस्मिनपश्चात् यथा अपवादित के यह जानते हुए या यह विश्वास रखने का कारण रखते हुए कि भारत सरकार की सेना, नौ सेना या वायु सेना के किसी ऑफिसर, सैनिक, नौसैनिक या वायु सैनिक ने अभित्यजन किया है, ऑफिसर, सैनिक, नौ सैनिक या वायु सैनिक को संश्रय देगा, वह दोनों में से किसी भाँति के कारावास से, जिसकी अवधि दो वर्ष तक की हो सकेगी, या जुर्माने से, या दोनों से, दण्डित किया जाएगा।

अपवाद- इस उपबन्ध का विस्तार उस मामले पर नहीं है, जिसमें पत्नी द्वारा अपने पति को संश्रय दिया जाता है।

[इस धारा के तहत अपराध गठित होने के लिए निम्नलिखित अनिवार्य अवयव हैं:

  • अभियुक्त ने भारत सरकार की सेना, वायु सेना या नौसेना के किसी अधिकारी, सैनिक, वायुसैनिक या नौसैनिक को संश्रय दिया है;
  • भारत सरकार के उस अधिकारी, सैनिक, वायुसैनिक या नौसैनिक ने अभित्यजन किया है;
  • अभियुक्त यह जानता है अथवा यह विश्वास करने का कारण रखता है कि उस अधिकारी; सैनिक, वायुसैनिक या नौसैनिक ने अभित्यजन किया है;
  • अभियुक्त उस अधिकारी, सैनिक, वायुसैनिक या नौसैनिक की पत्नी नहीं है।]

137. मास्टर की उपेक्षा से किसी वाणिज्यिक जलयान पर छिपा हुआ अभित्याजक- किसी ऐसे वाणिज्यिक जलयान का, जिस पर भारत सरकार की सेना, नौ सेना या वायु सेना का कोई अभित्याजक छिपा हुआ हो, मास्टर या भारसाधक व्यक्ति, यद्यपि वह ऐसे छिपने के सम्बन्ध में अनभिज्ञ हो, ऐसी शास्ति से दण्डनीय होगा जो पाँच सौ रूपये से अधिक नहीं होगी, यदि उस ऐसे छिपने का ज्ञान हो सकता था किन्तु केवल इस कारण नहीं हुआ कि ऐसे मास्टर या भारसाधक व्यक्ति के नाते उसके कर्तव्य में कुछ उपेक्षा हुई, या उस जलयान पर अनुशासन का कुछ अभाव था। 

[इस धारा के तहत अपराध गठित होने के लिए निम्नलिखित अनिवार्य तत्त्व हैं:

  • अभियुक्त उस वाणिज्यिक जलयान का मालिक या भारसाधक व्यक्ति हो,
  • उस वाणिज्यिक जलयान में भारत सरकार की सेनाए नौसेना या वायुसेना का कोई अभित्याजक छिपा हो;
  • अभियुक्त को उसके छिपने के तथ्य का ज्ञान इस कारण से नहीं था कि मालिक या ऐसे भारसाधक व्यक्ति के रूप में उसकी तरफ से कर्तव्य में उपेक्षा हुआ था या उस जलयान पर अनुसाशन का अभाव था।]

138. सैनिक, नौ सैनिक या वायु सैनिक द्वारा अनधीनता के कार्य का दुष्प्रेरण- जो कोई ऐसी बात का दुष्प्रेरण करेगा जिसे कि वह भारत सरकार की सेना, नौ सेना या वायु सेना के किसी ऑफिसर, सैनिक, नौ सैनिक या वायु सैनिक द्वारा अनधीनता का कार्य जानता हो, यदि अनअधीनता का ऐसा कार्य उस दुष्प्रेरण के परिणामस्वरूप किया जाए, तो वह दोनों में से किसी भाँति के कारावास से, जिसकी अवधि छह मास तक की हो सकेगी, या जुर्माने से, दोनों से, दण्डित किया जाएगा।

[इस धारा के तहत अपराध गठित होने के लिए निम्नलिखित अनिवार्य अवयव हैं:

  • अभियुक्त ने अनधीनता के किसी कार्य के लिए दुष्प्रेरण किया हो;
  • यह दुष्प्रेरण भारत सरकार की सेना, नौसेना या वायुसेना के किसी अधिकारी या सैनिक को किया गया हो;
  • ऐसा दुष्प्रेरण यह जानते हुए किया गया हो कि दुष्प्रेरित कार्य अनधीनता का कार्य है;
  • ऐसे दुष्प्रेरण के परिणामस्वरूप अनधीनता का वह कार्य कारित हुआ है।]

138क. पूर्वोक्त धाराओं का भारतीय सामुद्रिक सेवा को लागू होना- संशोधन अधिनियमए 1934 (1934 का 35) की धारा 20 तथा अनुसूची द्वारा निरसित

139. कुछ अधिनियमों के अध्यधीन व्यक्ति- कोई व्यक्ति, जो आर्मी एक्ट, सेना अधिनियम, 1950 (1950 का 46) नेवल डिसिप्लिन एक्ट, इण्डियन नेवी एक्ट, 1934 (1934 का 34), एयरफोर्स एक्ट या वायुसेना अधिनियम, 1950 (1950 का 45) के अध्यधीन है, इस अध्याय में परिभाषित अपराधों में से किसी के लिए इस संहिता के अधीन दण्डनीय नहीं है।

140. सैनिक, नौ सैनिक या वायु सैनिक द्वारा सैनिक उपयोग में लाई जाने वाली पोशाक पहनना या टोकन धारण करना- जो कोई भारत सरकार की सैन्य, नाविक या वायु सेना का सैनिक, नौ सैनिक या वायु सैनिक न होते हुए, इस आशय से कि यह विश्वास किया जाये कि वह ऐसा सैनिक, नौ सैनिक या वायु सैनिक है, ऐसी कोई पोशाक पहनेगा या टोकन धारण करेगा जो ऐसे सैनिक, नौ सैनिक या वायु सैनिक द्वारा उपयोग में लाई जाने वाली पोशाक या टोकन के सदृश हो, वह दोनों में से किसी भाँति के कारावास से, जिसकी अवधि तीन मास तक की हो सकेगी, या जुर्माने से, जो पाँच सौ रूपये तक का हो सकेगा, या दोनों से दण्डित किया जाएगा।

 [इस धारा के तहत अपराध गठित होने के लिए निम्नलिखित अनिवार्य अवयव हैं:

  • अभियुक्त भारत सरकार की सेना, नौसेना या वायुसेना का कोई सैनिक नहीं है;
  • लेकिन उसने ऐसा पोशाक या टोकन धारण किया हो जो भारत सरकार की सेना, नौसेना या वायुसैनिक द्वारा धारण की गई पोशाक या टोकन के सदृश है;
  • अभियुक्त ने ऐसा इस आशय से किया है कि लोग उसे भारत सरकार की सेना, नौसेना या वायुसेना के सैनिक या अधिकारी समझे। बिना ऐसे आशय से पहला गया पोशाक या टोकन इस धारा के तहत अपराध नहीं है।]
