अर्थात मेरी इच्छा के विरूद्ध किया गया कार्य मेरा नहीं है। इसी आशय से दूसरी उक्ति निकलती है “actus me invito factus non est mens actus” । अर्थात किसी कार्य के दंडनीय होने के लिए इच्छित होना अनिवार्य है।
इन दोनों सिद्धांत या सूत्र (maxim) का आशय यह है कि जब तक कोई कार्य दुराश्य से नहीं किया जाय तब तक वह दंडनीय नहीं होता है।

कोई भी कार्य तब तक अपराध की श्रेणी मे नहीं आता जब तक कि किसी विधि द्वारा उसे अपराध घोषित न कर दिया जाय। प्रसिद्ध सूत्र nulla poem sine lege अर्थात बिना विधि के दंड नहीं दिया जाय इसी वैधानिकता के सिद्धांत से निसृत है।

अर्थात अभियुक्त पश्चातवर्ती विचारण के दौरान पूर्व दोषमुक्ति और पूर्व दोषसिद्धि की सहायता ले सकता है। इसका आशय यह है कि एक ही व्यक्ति को एक ही अपराध के लिए दो बार दंडित नहीं किया जाय । इसे दुहरे खतरे का सिद्धांत कहते है।
यह सिद्धान्त भारतीय संविधान के अनुच्छेद (Article) 20 (2) और भारतीय दंड प्रक्रिया संहिता के सेक्शन 300(1) मे निहित है। लेकिन जहाँ अनुच्छेद 20 (2) मे विचारण और दोषसिद्धि आवश्यक है वहीं सेक्शन 300 (1) मे दोषसिद्धि के साथ दोष मुक्ति को भी मान्यता दिया गया है।
निर्दोषिता की उपधारणा (presumption of innocence)
इसका अर्थ यह है कि किसी व्यक्ति को तब तक निर्दोष माना जाय जब तक कि वह दोषी साबित न हो जाय । इस सामान्य नियम के कुछ अपवाद भी है।
ऐसे अपवाद के कुछ उदाहरण है – (1) साक्ष्य अधिनियम (Evidence Act) के सेक्शन 114 के दृष्टांत (क) के अनुसार चोरी का समान अगर किसी व्यक्ति के पास चोरी के तुरंत बाद मिले तो जब तक वह अपना अधिधारण न स्पष्ट करे तब तक उसे चोर माना जाएगा। (2) आईपीसी के सेक्शन 75 के अनुसार पूर्व मे दोषसिद्धि को एक निश्चित सीमा तक साक्ष्य के रूप मे प्रस्तुत किया जा सकता है और दंड में वृद्धि हो सकता है।
