ऐसे तो नहीं रुकेगा रेप
23 वर्ष की प्रभा (परिवर्तित नाम) उत्तर प्रदेश के एक छोटे शहर से दिल्ली प्रतियोगी परीक्षाओं की तैयारी करने आई थी। यहाँ एक लड़के ने उसकी अश्लील फोटो निकाल कर उसे ब्लैकमेल करना शुरू किया। प्रभा ने पुलिस में शिकायत की। महिला आयोग में शिकायत की। लेकिन कोई कार्यवाई नहीं हुई। पुलिस का कहना था कि किसी अपराध का कोई सबूत नहीं था। प्रभा अपने घर वाले को भी नहीं बताना चाहती थी क्योंकि मध्यम वर्ग के उसके पिता ने बहुत से सपने और आर्थिक भार लेकर उसे वहाँ भेजा था।
पुलिस से कोई मद्द नहीं मिलता देख कर आखिरकार प्रभा ने उसकी बात मान ली। नोएडा के एक होटल में एक रात वह उसके साथ रुकी। लेकिन वह लड़का जब बार-बार ऐसे दवाब बनाने लगा। उसने फिर पुलिस से मदद माँगा। पुलिस ने कहा कि घटना नोएडा में हुआ है इसलिए वहीं के पुलिस स्टेशन में केस दर्ज हो सकता है।
कई बार महिला आयोग और पुलिस में कहने पर भी कुछ नहीं हुआ तो उसने उससे शादी कर ली। शादी के दो महीने बाद महिला आयोग का नोटिस उस लड़के को मिला। पुलिस ने प्रेम का मामला मान कर अन्वेषण बंद कर दिया। बाद में पता चला कि लड़का पहले से ही शादीशुदा था और उसने झूठी शादी प्रभा को धोखा देने के लिए किया था। उसके शारीरिक अत्याचार से तंग आकार प्रभा फिर पुलिस और महिला आयोग के पास पहुँची। स्थिति अभी भी जस-की-तस है। दो साल हो गए है उसे चक्कर लगाते हुए।
अगर पुलिस या महिला आयोग तुरंत कार्यवाई करता तो संभवतः प्रभा को ब्लैकमेलर के सामने समर्पण नहीं करना पड़ता। कानूनी भाषा में इस स्थिति में समर्पण को “रेप” कहा जाता है। लेकिन क्या यह अपराध केवल अपराधी द्वारा किया गया, या सिस्टम भी इसमे सहभागी था?
एक और उदाहरण। दो भाइयों में दो मंज़िले घर को लेकर विवाद था। छोटे भाई ने अपने हिस्से का फ़र्स्ट फ्लोर किसी दबंग व्यक्ति को बेच दिया। उस दबंग व्यक्ति ने वह फ़र्स्ट फ्लोर किसी को रेंट पर दे दिया।
फ़र्स्ट फ्लोर पर रहने वाली किराएदार और सेकंड फ्लोर पर रहने वाले बड़े भाई के परिवार में हमेशा छोटी-छोटी बातों को लेकर झगड़े होते रहते थे; कभी सीढ़ियों पर कुत्ते बाँधने को लेकर, कभी सीढ़ी ब्लॉक करने को लेकर आदि । कई बार पुलिस और नगर निगम में शिकायतें भी दोनों तरफ से की गई थी।
फ़र्स्ट फ्लोर पर रहने वाली किराएदार ने सेकंड फ्लोर पर रहने वाले बड़े भाई के नाबालिग बेटे पर अपनी नाबालिग बेटी से जबरदस्ती करने का आरोप लगाया। लड़का, जो कि पायलट बनने के सपने देख रहा था, अपने विरुद्ध एफ़आईआर दर्ज होने के कारण कई बार दस्तावेज संबंधी परेशानी का सामना कर रहा है। इस घटना के 8 साल हो चुके हैं। अभियुक्त हर तारीख पर कोर्ट में इस उम्मीद में जाता है कि उसके केस का जल्दी फैसला हो जाए ताकि वह अपने सपने पूरे कर सके। जिस समय यह घटना/अपराध हुआ उस समय घर को लेकर कोर्ट में सिविल केस चलते हुए 13 वर्ष हो चुके थे।
ये दो उदाहरण हैं। ऐसे अनेक स्थितियाँ व्यवहार में होती हैं जहाँ लगता है, कानून के किताबों में अपराध के लिए मिलने वाले दण्ड को कठोर कर देने मात्र से कोई अधिक परिवर्तन नहीं होने वाला है।
बेटियों की सुरक्षा हमेशा से एक संवेदनशील और भावनात्मक मुद्दा रहा है। लेकिन हाल के वर्षों में इसका रूप थोड़ा बदला है। व्यक्तिगत से निकल कर यह सार्वजनिक और राजनीतिक मुद्दा बन चुका है।
हाल के वर्षों में जो एक पैटर्न देखने को मिला है, वह है- किसी लड़की के साथ दुष्कर्म होता है। आरंभ में आमलोग (याद कीजिए निर्भया सड़क किनारे पड़ी थी, लोग सड़क से बेपरवाह गुजर रहे थे), खास लोग या पुलिस अधिक ध्यान नहीं देते। फिर मीडिया इस घटना को प्रमुखता से उठाती है। क्योंकि ऐसी घटनाओं में समाज के हर वर्ग की सामान्यतः रुचि होती है। टीआरपी बढ़ाने का यह एक अच्छा जरिया होता है। आपसी प्रतियोगिता के कारण सभी चैनल और समाचार पत्र घटना को अधिक विस्तार से और भावनात्मक रूप से उठाने लगते हैं। लोगों की संवेदना उस से जुड़ जाती है क्योंकि उन्हें अपने बेटियों की चिंता सताने लगती है।
फिर यह टॉपिक सोशल मीडिया पर ट्रेंडिंग होने लगता है। कुछ लोग पीड़िता के धर्म, जाति आदि को परखते हैं कि अगर उन्हें अपने समुदाय का अधिक हितैषी बनने का मौका मिल रहा हो तो सोने पर सुहागा, अगर नहीं, फिर भी महिला हितैषी दिखने का मौका बन जाता है उनके लिए। आधी आबादी यानि महिला वोटर का राजनीतिक दृष्टि से भी निर्णायक महत्व होता है। पुरुष भी भावनात्मक रूप से ऐसे मुद्दे से स्वयं को जुड़ा महसूस करते हैं। इसलिए सभी आम और खास लोग ऐसे मुद्दे को अधिक से अधिक उठाने का प्रयास करते हैं। ताकि उन्हें अधिक-से-अधिक महिला हितैषी समझा जाय। राजनीतिक दल भी मौके का फायदा उठाने से क्यों चुके?
मीडिया और सोशल मीडिया के शोर में असली मुद्दा और अपराध शास्त्र और न्यायशास्त्र के सिद्धांत कहीं दब जाते हैं। आरोपी दोषी माने जाने लगते हैं। उनके लिए कठोर दण्ड की माँग होने लगती है।
इस वातावरण का प्रभाव सरकार और कोर्ट पर भी पड़ता है। जनता को खुश करने और अपनी छवि बचाने के लिए सरकार जल्दी-जल्दी में कुछ कानून पास कर देती है। पीड़ित या उसके परिवार को आर्थिक सहायता देती है। कोर्ट भी कई बार जनहित याचिका पर या स्वतः संज्ञान लेकर आदेश पारित करने लगता है।
यह सब कार्य जल्दी में और टुकड़ों में किया जाता है। ये थोड़े-बहुत उपाय ऐसे होते हैं जैसे टूटे दीवार की मरम्मत के बजाय उसके ऊपर से रंग-रोगन कर उसे सुंदर बना दिया जाय । लेकिन आंतरिक मूल कमियाँ अनदेखी ही रह जाती है। कुछ दिनों बाद शोर थमने लगता है। किसी नए घटनाक्रम के साथ फिर से कमोवेश यही शृंखला दुहराई जाती है।
तो ऐसे क्या अपराध रुकेगा? वास्तव में अगर हम अपराध रोकना चाहते हैं तो हमे अपराध और अपराधियों के प्रति हमारे दृष्टिकोण को बदलना होगा। अगर आमलोग अपना दृष्टिकोण बदल लें और भावनात्मक आवेग से सोचने के बदले स्थिर और विस्तृत दृष्टि से सोचे तो संभवतः ऐसे घटनाओं से लाभ उठाने वाले लोग भी थोड़ा ठिठकेंगे और कोई स्थायी समाधान निकल पाएगा। ऐसे अपराधों के लिए अपना दृष्टिकोण बनाते समय हमे कुछ बातें ध्यान में रखनी होगी:
- कोई भी अपराध, भले ही वह हत्या हो, अपहरण हो, रेप हो, या कोई अन्य अपराध, विकृत मानसिकता का ही परिणाम होता है। जिस समय हम अपराधों और अपराधियों को अपनी सुविधा के अनुसार वर्गीकृत करने लगते हैं, उसी समय अनजाने में ही हम भी उस अपराध के सहभागी बन जाते हैं। अगर हम अपराध को दलित, सवर्ण, अल्पसंख्यक, बहुसंख्यक आदि के रूप में वर्गीकृत कर देखने लगेंगे तो स्वाभाविक रूप हमारी दृष्टि में अपराध और अपराधी का रूप धूमिल होने लगेगा और निहित स्वार्थ के लोग इसका फायदा उठाएँगे।
- यौन अपराधों को भी एक सामान्य अपराध की तरह मानते हुए अन्वेषण और न्याय के सिस्टम को अधिक सक्षम किए जाने की जरूरत है। कई बार देखा गया है कि इस तरह के अपराध किस पूर्व विवाद का परिणाम होता है, या पीड़िता को इसकी आशंका पहले से ही होती है। सामान्य रूप से अन्वेषण और न्याय के सिस्टम को शीघ्र और अधिक कुशल किए बिना अपराध नहीं रुकेगा।
- जनता के दवाब में सरकार ने जल्दी में कानून तो बना देती है लेकिन उस कानून को लागू करने के लिए सिस्टम तो पुराना ही रहता है। इसलिए ये कानून व्यवहार में अधिक प्रभावी नहीं हो पाते हैं।
- जिस दौरान कोई एक अपराध मीडिया में छाया होता है, उस दौरान अन्य अपराधों से लोगों का ध्यान हट जाता है। अगर मीडिया द्वारा किसी को अपराधी कहने से लोग उसे अपराधी मानने लग जाएँ तो ऐसे झूठे आरोप लगाने की प्रवृति भी बढ़ सकती है। हमारे सिस्टम में प्रत्येक कार्य के लिए जिम्मेदारी बंटी हुई है। अगर सिस्टम सही से कार्य नहीं कर पा रहा है तो सिस्टम तो सही करना चाहिए न कि किसी और की जिम्मेदारी कोई और निभाने लगे।
जब तक आम जनता अपराधियों के प्रति अपना दृष्टिकोण नहीं बदलेगी और हमारी पुलिस एवं न्याय वयवस्था ऐसी नहीं होगी कि अपराधियों को यथाशीघ्र दण्ड मिलना सुनिश्चित हो, तब तक अपराध नहीं रुकेगा।
