घरेलू हिंसा अधिनियम, 2005 (Domestic Violence Act, 2005)
शारीरिक हिंसा यानि मारपीट समाज द्वारा हमेशा से सामान्यतः अपराध माना जाता रहा है, लेकिन फिर भी इस तरह की हिंसा घरों के अंदर भी होती रही है जिसकी शिकार सामान्यतः महिलाएं ही होती रही हैं। आस-पड़ोस के लोग इसे दूसरे का घरेलू मामला मान कर सामान्यतः हस्तक्षेप नहीं करते हैं। हस्तक्षेप नहीं करने का एक कारण महिलाओं को पुरुषों की संपत्ति मानने की पुरातन सोच भी है। लेकिन घरेलू हिंसा के आंकड़े इतने भयानक है कि कानून निर्माताओं का ध्यान भी इसकी तरफ गया। इसी का परिणाम था 2005 मे बना “घरेलू हिंसा से महिलाओं का संरक्षण अधिनियम (Protection of Women from Domestic Violence Act, 2005) जिसे संक्षेप मे घरेलू हिंसा अधिनियम या इंग्लिश Domestic Violence Act कहते है।
घरेलू हिंसा क्या है?
घरेलू हिंसा अधिनियम के तहत ऐसे किसी भी कार्य को घरेलू हिंसा माना जाता है जिससे महिला के स्वास्थ्य सुरक्षा या जीवन को हानि पहुंचे, या ऐसा होने का खतरा हो। इसमें शारीरिक, मानसिक, भावनात्मक, आर्थिक, और सेक्सुअल पाँच तरह के अत्याचार या हिंसा को माना गया है। दहेज व संपत्ति की मांग के लिए महिला को परेशान करना, उसे हानि पहुंचाना, या ऐसा करने का खतरा पैदा करना, भी घरेलू हिंसा माना जाता है। ऐसे हिंसा की धमकी एक महिला को, या उसके किसी संबंधी, को देना भी घरेलू हिंसा में शामिल है
घरेलू हिंसा अधिनियम, 2005 के तहत कौन शिकायत कर सकता है?
जैसा कि इसके नाम से ही स्पष्ट होता है यह महिलाओ की सुरक्षा के लिए बनाया गया है, इसलिए इसके तहत केवल महिलाएं ही शिकायत यानि परिवाद (complaint) कर सकती है, पुरुष नहीं। ऐसी शिकायत या परिवाद करने के लिए केवल दो शर्ते है –
पहला, महिला (परीवादिनी या complainant) और उसने जिसके विरुद्ध प्रतिवाद या शिकायत की है यानी प्रतिवादी (Respondent) एक ही घर में रह रहे हो। लेकिन साथ रहने का समय अवधि अप्रासंगिक है।
दूसरा, उन दोनों में किसी न किसी तरह का संबंध हो। यह संबंध रक्त का या वैवाहिक हो सकता है। गोद ली हुई संतान को भी रक्त संबंध मे माना जाता है। लेकिन एक ही घर में रहने वाले लोग जिनका आपस में कोई संबंध नहीं है; जैसे,घर में काम करने वाली नौकरानी, अतिथि, किरायेदार इत्यादि इस कानून के तहत शिकायत नहीं कर सकते है। उनके लिए अलग कानून है।
घरेलू हिंसा अधिनियम, 2005 के तहत किसके विरुद्ध शिकायत की जा सकती है?
इस कानून के तहत किसी भी पुरुष संबंधी, जो समय की किसी भी अवधि (period of time) तक और किसी भी किसी बिन्दु (point of time) पर, एक सांझे घर मे उसके साथ रहा हो, के विरुद्ध परिवाद किया जा सकता है, चाहे वह पुरुष संबंधी पिता, पति, भाई, चाचा, ससुर इत्यादि कुछ भी क्यो न हो। अर्थात परिवाद के लिए केवल तीन शर्तें है –
- प्रतिवादी पुरुष हो और उसकी उम्र 18 वर्ष से ज्यादा हो,
- उसका परीवादिनी से किसी-न-किसी तरह का संबंध हो, यह संबंध रक्त, विवाह या दत्तक से हो सकता है।
- दोनों किसी भी समय बिन्दु पर एक ही घर मे रहे हो।
पीड़ित महिला घरेलू हिंसा अधिनियम, 2005 के शिकायत किस तरह और कहां कर सकती हैं?
सबसे पहले परिवादिनी (अर्थात वह महिला, जो परिवाद या शिकायत करती है, यानि पीड़ित महिला) को एक लिखित परिवाद (complaint) तैयार करना चाहिए, जिसमें उसके विरुद्ध जिस तरह से हिंसा हो रहा है, या हुआ है, उसका स्पष्ट उल्लेख होना चाहिए। साथ ही, उसे यह भी लिखना चाहिए कि वह क्या चाहती है।
उसे यह जुडिशल मजिस्ट्रेट फर्स्ट क्लास, या जहां उपलब्ध है, वहां मेट्रोपोलिटन मजिस्ट्रेट कोर्ट में देगा होगा। एक महिला सुरक्षा अधिकारी (protection officer), जो कि एक पुलिस अधिकारी होती है, उससे मिल कर वस्तुस्थिति का पता करने का प्रयास करेगी। वहशिकायत (परिवाद) की जांच-पड़ताल कर अपनी रिपोर्ट कोर्ट में देती है। इस रिपोर्ट के आधार पर जब कोर्ट संतुष्ट हो जाता है कि घरेलू हिंसा हुआ है, तब प्रतिवादी को नोटिस करता है, और मुकदमे की सुनवाई शुरू हो जाती है।
क्या ऐसे विशेष राहत हैं जो पीड़ित महिला इस कानून के तहत मांग सकती है?
घरेलू हिंसा अधिनियम, 2005 के तहत महिला पाँच तरह के अधिकार या राहत की मांग कर सकती है। ये हैं:
1. सुरक्षा का अधिकार –
कोर्ट को अगर प्रथम दृष्टया लगता है कि घरेलू हिंसा हो रहा है, तो प्रतिवादी (वह व्यक्ति जिसके विरुद्ध शिकायत की गई है) को यह आदेश दे सकता है कि ओव कोई घरेलू हिंसा ना करें,और ना ही किसी अन्य व्यक्ति को ऐसा करने के लिए उकसाए ।
आवश्यकता होने पर उसे पीड़ित महिला के कार्य-स्थल, कॉलेज या स्कूल मे प्रवेश करने से रोका जा सकता है। उस मौखिक या लिखित रूप से, फोन,इंटरनेट इत्यादि किसी भी तरह से उस महिला से संपर्क करने से माना किया जा सकता है। इतना ही नहीं,ऐसे किसी भी संपत्ति जिसमे उस महिला का, या उसके किसी अपने का हक या हित हो, को बेचने या किसी को देने से भी रोका जा सकता है।
यह राहत/सुरक्षा पीड़ित महिला को ही नहीं बल्कि जरूरत पड़ने पर उस अन्य व्यक्ति को भी दिया जा सकता है, जिसने उसकी सहायता की हो या कर रहा/रही हो।
2. रहने के लिए घर का अधिकार –
इस अधिकार का मकसद यह है कि अगर कोई महिला शिकायत करती है,तो उसे घर से निकाला ना जा सके, और न हीं उसे घर के अंदर तंग किया जा सके। इसके तहत कोर्ट उस घर, जिसमें पीड़ित महिला रह रही है, को बेचने या किसी को देने से रोक सकता है।
प्रतिवादी को, या उसके किसी भी प्रतिनिधि को, घर में, या घर के जिस हिस्से में पीड़ित महिला रहती है, में प्रवेश करने से रोका जा सकता है। इतना ही नहीं, यदि आवश्यकता हो तो कोर्ट प्रतिवादी को आदेश दे सकता है कि वह पीड़ित महिला के लिए किराए पर अलग घर की व्यवस्था करें, और उसका किराया दे।
3. आर्थिक सहायता –
इसके तहत कोर्ट पीड़ित महिला के खर्चे के लिए, और उसे होने वाली हानि के लिए, प्रतिवादी से पैसा दिला सकता है।
4. बच्चों की कस्टडी का अधिकार –
केस चलने के दौरान, किसी भी समय, अगर पीड़ित महिला मांग करें, तो उसे अस्थाई रूप से अपने बच्चों की कस्टडी मिल सकता है। कोर्ट को यदि ऐसा लगे कि प्रतिवादी का बच्चों की से मिलना बच्चों के लिए हानिकारक है, तो उसे बच्चों से मिलने से भी रोक सकता है।
इसमे मिलने वाला कस्टडी अस्थायी होता है, स्थायी कस्टडी के लिए फैमिली कोर्ट मे अलग से कस्टडी का केस फ़ाइल करना होगा।
5. क्षतिपूर्ति (compensation) का अधिकार –
पीड़ित महिला को हुए शारीरिक व मानसिक पीड़ा के लिए कोर्ट प्रतिवादी क्षतिपूर्ति भी दिला सकता है।
इन मुख्य अधिकारों के अलावा पीड़ित महिला को काउंसलिंग पाने, वेलफेयर एक्सपर्ट से सहायता पाने और “इन कैमरा” यानि बंद कमरे में मुकदमे की सुनवाई, का भी अधिकार है, और वह इसके लिए भी कोर्ट से मांग कर सकती है। इतना ही नहीं, चूंकि केस के अंतिम रूप से निपटारे मे समय लग सकता है,इसलिए केस चलते रहने के द्वारा अंतरिम राहत का भी प्रावधान है।
क्या इन अधिकारों का दुरुपयोग निर्दोष पुरुषों को तंग करने के लिए भी किया जा सकता है?
निःसन्देह इस कानून ने महिलाओं को बहुत अधिकार दिए हैं, पर इसका दुरुपयोग रोकने के लिए भी कुछ प्रावधान है। घरेलू हिंसा कानून के तहत महिला हीकेवल शिकायत के आधार पर ही कार्रवाई नहीं शुरू हो जाती है, बल्कि एक सुरक्षा अधिकारी अधिकारीप्रारंभिक रूप से जांच करती है और उसके द्वारा शिकायत सही पाए जाने पर ही कोर्ट मुकदमे की कारवाई शुरू करता है। कोर्ट सभी तथ्यों को ध्यान में रखकर ही प्रतिवादी के विरुद्ध कोई आदेश पारित करता है।
क्या इस कानून के तहत महिलाओं के विरुद्ध भी शिकायत की जा सकती है?
यद्यपि इस कानून के तहत महिलाओं के विरुद्ध शिकायत की जा सकती है और महिला रिश्तेदारों को मुकदमे का पक्षकार बनाया जा सकता है। पर, उनके विरुद्ध कोई दावा (claim) नहीं मांगा जा सकता है, क्योंकि इस कानून का नाम ही है घरेलू हिंसा के विरुद्ध महिलाओं की सुरक्षा। इसलिए यह महिलाओ की सुरक्षा के लिए है उनके विरुद्ध किसी दावा के लिए इसका प्रयोग नहीं किया जा सकता है।
क्या घरेलू हिंसा कानून में पत्नी सास-ससुर की संपत्ति से मेंटेनेंस मांग सकती है?
इस कानून के तहत महिला सास से कोई दावा नहीं कर सकती है। लेकिन यदि ससुर को प्रतिवादी बनाया है, तो उससे क्षतिपूर्ति कि मांग कर सकती है। पर, भरण-पोषण के लिए खर्चा (maintenance) वह केवल पति की आय से और पति की संपत्ति से ले सकती है। रहने का अधिकार भी वह उसी घर मे मांग सकती है, जो पति ने खरीदा हो, किराए पर लिया हो, या उस घर मे पति का हिस्सा हो। ससुर के व्यक्तिगत संपत्ति पर उसका अधिकार नहीं होगा।
अगर पति–पत्नी सास-ससुर से अलग रहते है और सास-ससुर कभी-कभी उनसे मिलने आते है,तो इस स्थिति मे भी उनपर इस अधिनियम के तहत केस हो सकता है?
हाँ, उन्हे भी केस मे पक्षकार बनाया जा सकता है। क्योंकि इस कानून के लागू होने के लिए केवल तीन शर्तें हैं
- घरेलू हिंसा हुआ हो,
- घरेलू हिंसा करने वाले और सहने वाले में किसी तरह का संबंध हो, और
- दोनों केस करते समय, या इससे पहले किसी भी समय, एक ही घर में साथ रहे हो। हिंसा कितने दिन तक साथ रहने पर किया जा सकता है, इसकी कोई निश्चित सीमा नहीं हो सकती। इसलिए इसमें किसी समय अवधि का प्रावधान नहीं है।
