एक वैध हिन्दू विवाह की संकल्पना, प्रारूप और उसके लिए आवश्यक रस्में (Concept and forms of a valid Hindu marriage, solemnization of marriage)

हिन्दू विवाह के शास्त्रीय रीति के अनुसार निम्नलिखित तीन अनुष्ठान सामान्यतः सभी हिन्दुओं में मान्य है:  

  • 1. कन्यादान और पाणिग्रहण
  • 2. विवाह होम, और
  • 3. सप्तपदी।

फिर भी विभिन्न समुदायों एवं क्षेत्रों में विवाह के विभिन्न तरीकें एवं रस्म-रिवाज होते हैं। किसी भी समाज विशेष के परम्परागत तरीके से हुए विवाह को यह कानून मान्यता देता है अर्थात् विवाह के लिए किसी विशेष आयोजन या रस्म की जरूरत नहीं है। अधिकांश समुदाय में सप्तपदी को विवाह के लिए आवश्यक रस्म माना जाता है। जिन समुदायों में सप्तपदी मान्य है वहाँ सप्तपदी का सातवाँ पद पूरा होते ही विवाह सम्पन्न माना जाता है।

जिन समुदायों में इसके बजाय कोई अन्य मूल रस्म मान्य है वहाँ उसे यह अधिनियम भी मान्यता देता है।

महत्वपूर्ण मुकदमें (Case Laws)

एस नागलिंगम वर्सेज शिवागामी (2001, 7 SCC 487)

तथ्य

शिवागामी (पत्नी) और नागलिंगम (पति) की शादी 1970 में हुई। इस शादी से दोनों के तीन बच्चे हुए। पति के बुरे व्यवहार और शारीरिक प्रताड़ना से तंग आकर पत्नी अपने पिता के साथ रहने लगी। इसी बीच पति ने दूसरी शादी कर ली। पत्नी ने पति के खिलाफ आपराधिक वाद दायर किया।           

निचली अदालत ने पति को इस आधार पर बरी कर दिया कि दूसरी शादी में शादी के लिए एक अनिवार्य रस्म “सप्तपदी” नहीं किया गया था और इसलिए यह शादी विधिमान्य नहीं थी। चूँकि दूसरी शादी विधिमान्य नहीं थी इसलिए पति ने द्विविवाह का अपराध नहीं किया था।

पत्नी ने इस फैसले के विरूद्ध मद्रास हाई कोर्ट में अपील किया। हाई कोर्ट का तर्क था कि दोनों पक्षकार हिन्दू विवाह अधिनियम की धारा 7 में राज्य संशोधन करके जोड़ी गई धारा 7A से प्रशासित होते हैं इसलिए दूसरी शादी विधिमान्य है और पति द्विविवाह के अपराध का दोषी था। अब पति ने सुप्रिम कोर्ट में अपील किया।

विधिक प्रश्न

सुप्रिम कोर्ट के समक्ष मूल विचारणीय मुद्दा यह था कि–

क. क्या सप्तपदी ऐसा अनिवार्य रस्म है जो बिना अपवाद के सभी तरह के हिन्दू विवाहों में निभाया जाए? और

ख. क्या अपीलार्थी पति द्वारा सप्तपदी के रस्म को निभाए बिना की गई शादी मान्य है और पति भारतीय दण्ड संहिता की धरा 494 के तहत द्विविवाह के लिए दोषी है?

प्रेक्षण

सुप्रिम कोर्ट (न्यायमूर्ति के जी बालाकृष्णन्) ने इस मामले में निम्नलिखित तर्क दिया-

कोर्ट के अनुसार भारतीय दण्ड संहिता की धारा 494 के लागू होने के लिए निम्नलिखित अनिवार्य घटक होना चाहिए:

क. आरोपी ने पहले विवाह किया हो,

ख. दूसरे विवाह के समय पहला विवाह अस्तित्व में हो,

ग.  और दोनों विवाहों में वर एवं वधु दोनों पक्षों पर लागू वैवाहिक नियमों के अनुसार अनिवार्य रस्मों का पालन हुआ हो।

प्रस्तुत मामले में पहला और दूसरा घटक उपस्थित था अर्थात् दूसरे विवाह के समय पहला विवाह अस्तित्व में था।

सुप्रिम कोर्ट का मानना था कि हिन्दू विवाह अधिनियम की धारा 7 विवाह के लिए उस समुदाय विशेष में परम्परागत रूप से मान्य रस्मों को मान्यता देता है। सप्तपदी की रस्म सभी प्रकार के हिन्दू विवाहों के लिए अनिवार्य नहीं है। अपितु केवल उन्हीं समुदायों के लिए अनिवार्य है जहाँ परम्परागत रूप से विवाह के लिए यह अनिवार्य घटक माना जाता है।

अर्थात् समुदाय विशेष एवं क्षेत्र विशेष के व्यक्तिगत कानून वरीय होंगे। तमिलनाडू सरकार ने हिन्दू विवाह अधिनियम में संशोधन कर धारा 7A जोड़ा था। इसके अनुसार तमिलनाडू में विवाह के लिए सप्तपदी आवश्यक नहीं था। बल्कि माला एवं अँगूठी का आदान-प्रदान एवं वर द्वारा वधू को थालि (मंगलसूत्र) पहनाने और दोनों द्वारा समझे जाने वाली भाषा में विवाह की घोषणा से ही विवाह सम्पन्न माना जाता था।

निर्णय

अपीलार्थी के द्वितीय विवाह में इन रस्मों का पालन हुआ था। इसलिए यह विवाह अनिवार्य रस्मों के अनुसार हुआ था और पति धारा 494 के तहत दोषी था।

भाऊराव लोखांडे वर्सेस स्टेट ऑफ महाराष्ट्र (AIR 1965 SC 1564; (1965) 2 SCR 837)

तथ्य

भाऊराव की शादी 1956 में इंदूबाई से हुई। इंदूबाई के जीवित रहते हुए 1962 में उसने कमलाबाई से शादी कर ली। उसे भारतीय दण्ड संहिता की धारा 494 के तहत दोषी पाया गया।

सेशन कोर्ट और हाई कोर्ट में उसकी अपील खारिज हो गई। उसने सुप्रिम कोर्ट में अपील किया।

विवाद

अपीलार्थी का एकमात्र तर्क यह था कि उसका दूसरा विवाह सम्यक् रस्मों से नहीं हुआ था। इसलिए वह विवाह नहीं था और वह धारा 494 के तहत दोषी नहीं था।

जबकि अभियोजन पक्ष की दलील थी कि उस क्षेत्र में मान्य परम्पराओं के अनुसार “गंधर्व विवाह” में प्रचलित रीति-रिवाजों का इस विवाह में पालन किया गया था इसलिए दूसरा विवाह मान्य था और अपीलार्थी धारा 494 के तहत दोषी था।

विधिक प्रश्न

इस मामलें में निम्नलिखित मुद्दे विचारण के लिए न्यायालय ने तय किया–

1 द्विविवाह के अपराध के लिए अनिवार्य तत्व क्या है?

2 विवाह के लिए आवश्यक रीति या धार्मिक अनुष्ठान (solemnization of marriage) क्या है?

3 धारा 494 के तहत द्विविवाह के अपराध के लिए दूसरा विवाह दोनों पक्षों के बीच लागू होने वाले कानून के अनुरूप सम्यक् रूप से होना क्या अनिवार्य है?

प्रेक्षण

सुप्रिम कोर्ट (न्यायमूर्ति रघुबर दयाल) ने निम्नलिखित तर्कों को माना–

हिन्दू विवाह अधिनियम की धारा 5 के अनुसार दो हिन्दूओं के बीच हुआ विवाह वैध है अगर इसमें कुछ शर्ते पूरी हो। इनमें से एक शर्त यह है कि दोनों पक्षों में से किसी भी पक्ष का कोई जीवित पति या पत्नी विवाह के समय नहीं हो।

इसी अधिनियम की धारा 17 के अनुसार इस अधिनियम के लागू होने के पश्चात् किन्ही दो हिन्दुओं के बीच होने वाला ऐसा विवाह शून्य होगा यदि इस विवाह की तिथि को पति या पत्नी दोनों पक्षों में से किसी का भी जीवित पति या पत्नी हो। ऐसा विवाह होने की स्थिति में भारतीय दण्ड संहिता की धारा 494 और 495 लागू होगी। 

विवाह अनुष्ठित (solemnized) होने का अर्थ है विवाह का उचित एवं सम्यक् रीति से सम्पन्न होना। यह उचित एवं सम्यक् रीति उस क्षेत्र विशेष और समुदाय विशेष में लागू नियमों, औपचारिकताओं एवं समारोहों के अनुसार होना चाहिए।

अगर विवाह इस रीति से नहीं होगा तो उसें कानून की दृष्टि में विवाह सम्पन्न होना नहीं माना जाएगा और इस विवाह के पक्ष पति और पत्नी की स्थिति नहीं पा सकेंगे।

उपर्युक्त दृष्टिकोण को अपनाते हुए कोर्ट ने निम्नलिखित निर्णय दिया कि 1962 में अपीलार्थी एवं कमलाबाई के बीच हुआ विवाह “गंधर्व विवाह” का एक रूप था जो कि महाराष्ट्र क्षेत्र में प्रचलित था।

इसमें विवाह के लिए अनिवार्य दो तत्वों– पवित्र अग्नि के समक्ष शपथ लेना और सप्तपदी, नहीं किया गया था। इस बात का कोई सबूत नहीं था कि ये दोनों रस्म इस क्षेत्र में मान्य प्रथा के अनुसार विवाह के लिए आवश्यक नहीं था।

अभियोजन पक्ष का दावा था कि इस क्षेत्र में गधर्व विवाह के प्रचलित रूप में दुल्हा और दुल्हन दोनों के लिए ललाट के स्पर्श करने से विवाह सम्पन्न होना मान लिया जाता था।

धारा 3 (a) के अनुसार रिवाज एवं परम्परा उस क्षेत्र में एक लम्बे समय तक सामान्य रूप से प्रचलित होने पर नियम के रूप में स्वीकार किया जाता हो, तभी उसे उस क्षेत्र या समुदाय में कानून के रूप में माना जा सकता है।

अभियोजन पक्ष इस बात को साबित नहीं कर पाया कि दुल्हा एवं दुल्हन द्वारा ललाट के स्पर्श से गंर्धव विवाह के सम्पन्न हो जाने का रिवाज इस तरह से कानून के रूप में मान्य था।

निर्णय

अतः अपीलार्थी का दूसरा विवाह विधिपूर्वक सम्पन्न होना नहीं माना जा सकता है और इसलिए वह भारतीय दण्ड संहिता की धारा 494 और 495 के तहत दोषी नहीं था।

प्रश्न- अशोक एवं आशा का विवाह हिन्दू रीति रिवाजों के अनुसार हुआ। विवाह के बाद अशोक की घनिष्ठता प्रीति से हो गई और दोनों ने विवाह करने का निर्णय किया। दिल्ली में मित्रों की उपस्थिति में केवल एक-दूसरे को माला पहना कर उन्होंने विवाह कर लिया। आशा ने उसके विरूद्ध द्विविवाह के लिए क्रिमिनल केस किया। अशोक के द्वितीय विवाह की विधिमान्यता का विधिक प्रावधानों और न्यायिक निर्णयों के प्रकाश में परीक्षण कीजिए। 2012
