संविदा अधिनियम मे अनुसार विकृतचित्त व्यक्ति कौन है?

विकृतचित्त व्यक्ति से संविदा विधि द्वारा मान्य नहीं होता है। क्योंकि संविदा के लिए यह आवश्यक है कि दोनों पक्षों की सहमति हो और यह सहमति स्वतंत्र (free) हो। अर्थात केवल सहमति ही नहीं, बल्कि ऐसी सहमति हो जो उसके परिणामों और प्रभावों के विषय में सोचसमझ कर दी गई हो।

लेकिन अस्वस्थ मस्तिष्क का व्यक्ति या अवयस्क व्यक्ति ऐसा करने में सक्षम नहीं हो सकता है। इसलिए विधि ऐसे व्यक्तियों को संविदा करने के लिए योग्य नहीं मानता है।

अगर ऐसे व्यक्ति संविदा कर लेते हैं तो वह विधि की दृष्टि में शून्य अर्थात संविदा नहीं माना जाता है। यानि ऐसे संविदा से किसी तरह के अधिकार या दायित्व उत्पन्न नहीं होता है। 

इस संबंध में दो तरह का प्रश्न उठता है:

  1. विकृतचित्त या अस्वस्थ मस्तिष्क का व्यक्ति किसे माना जाएगा; और 
  2. अगर इनसे की गई संविदा के तहत दूसरा पक्ष कोई कार्य करता है और कुछ खर्च करता है, तो क्या उसे यह रकम वापस पाने का अधिकार है।

इन दोनों प्रश्नो के संबंध में प्रावधान विकृतचित्त व्यक्ति के संबंध में भी मुख्य प्रावधान वैसे  ही हैं जैसे अवयस्क से संविदा के लिए  है। 

अधिनियम का सेक्शन 12 स्वस्थचित्त की परिभाषा देता है। यह परिभाषा वास्तव में स्वस्थचितता की अवधारणा देता है। अगर कोई व्यक्ति संविदा करने के समय

  • (1) संविदा को समझने, और
  • (2) अपने हितों पर उसके प्रभावों को समझने के लिए सक्षम हो,

तो यह माना जाएगा कि वाद संविदा के उद्देश्य के लिए स्वस्थचित्त है। यह मेडिकल स्वास्थ्यचितता से भिन्न होता है। यह हो सकता है कि संविदा से पहले या बाद में वह इसे समझने के लिए सक्षम नहीं हो, लेकिन इसमे मर्मभू समय संविदा करते समय होता है।

विकृतचित्त व्यक्ति से संविदा आरंभ से ही शून्य (void ab initio) होता है। इस से संबंधित प्रावधान अधिकांशतः वैसे ही है जैसे कि अवयस्क के होते हैं। सेक्शन 68 के तहत आवश्यताओं की पूर्ति के लिए उपलब्ध कराए गए वस्तु के लिए इस तरह से व्यक्ति की संपत्ति से की जा सकती है।

किन व्यक्तियों को कानून द्वारा संविदा करने के लिए अयोग्य माना जाता है (Persons debarred by law)?

  1. युद्ध के दौरान विदेशी शत्रु (alien enemies) अर्थात उस देश या देशों के नागरिक जिनके साथ युद्ध घोषित है। इस दौरान कोई नया कांट्रैक्ट नहीं हो सकता और अगर पहले से कोई कांट्रैक्ट है तो वह युद्ध घोषित रहते समय निलंबित (suspend) रहता है या समाप्त (dissolved) हो जाता है;
  2. विदेशी सार्वभौम (foreign sovereign), या किसी कूटनीतिक अधिकारी के साथ केंद्र सरकार के पूर्व अनुमति के बिना कांट्रैक्ट नहीं किया जा सकता है;
  3. कार्पोरेशन अपने मेमोरेंडम और विनियमों द्वारा शासित होते है। वे इस तरह का कोई कांट्रैक्ट नहीं कर सकते जो पूर्णतः व्यक्तिगत प्रकृति का हो; 
  4. जो व्यक्ति दिवालिया घोषित होने के कारण विधि द्वारा कांट्रैक्ट करने के लिए अयोग्य हो गए हो; 
  5. कोई सजा प्राप्त (convicted) अपराधी जेल में रहने के दौरान कांट्रैक्ट नहीं कर सकता है, लेकिन अगर वह किसी भी कारण से (जैसे क्षमा मिलने, सजा काट लेने आदि), अगर जेल के बाहर आ जाए तो कांट्रैक्ट कर सकता है।
