सदृश-संविदाएँ (Quasi-Contract)

भारतीय संविदा अधिनियम (the Indian Contract Act) के अध्याय 5 के सेक्शन 68 से 72 (chapter IV S. 68-72) में ऐसे स्थितियों के लिए प्रावधान है जहाँ यद्यपि दोनों पक्षो में कोई संविदा नहीं नहीं लेकिन विधिक सिद्धांत के कारण उसे संविदा की तरह ही माना जाता है इसलिए इन्हे संविदा नहीं बल्कि सदृश-संविदा (quasi-contract) यानि संविदा-जैसा कहते हैं।

सदृश-संविदा का सिद्धांत कॉमन लॉ के इस सिद्धांत से निकला है कि किसी भी व्यक्ति को किसी अन्य व्यक्ति के मूल्य पर अन्यायपूर्ण लाभ प्राप्त नहीं होना चाहिए। इसमे दोनों पक्षो में यद्यपि कोई संविदा नहीं हुआ रहता है लेकिन एक पक्ष के मूल्य पर दूसरे को लाभ प्राप्त हुआ होता है।

इसलिए वह इस लाभ के लिए प्रतिकार उस व्यक्ति को देने के लिए बाध्य होता है जिसे हानि हुई है। यह बाध्यता किसी संविदा या अपकृत्य से नहीं बल्कि उसके द्वारा प्राप्त अन्यायोचित लाभ से उत्पन्न होता है। यानि कि यहाँ संविदा नहीं होती है लेकिन संविदा के समान मानने की न्यायिक अवधारणा होती है।

सदृश-संविदा (quasi-contract) का सिद्धांत कब लागू होता है?

सदृश-संविदा में अन्यायोचित लाभ को साबित करने के लिए इन तथ्यों को साबित करने होता है अर्थात इन तीन तत्त्वों के होने पर ही इस के तहत अनुतोष (relief) मिल सकता है:

1. प्रतिवादी को किसी लाभ की प्राप्ति हुई है,

2. यह लाभ वादी को हानि करके प्राप्त हुई है,

3. यह लाभ अन्यायपूर्ण है।

भारतीय संविदा अधिनियम में कितने प्रकार के सदृश-संविदा का उल्लेख है?

संविदा अधिनियम में निम्नलिखित प्रकार के सदृश संविदा का उल्लेख है:

 सदृश-संविदा
सेक्शन 68संविदा करने में असक्षम व्यक्तियों को उपलब्ध कराई गई आवश्यक वस्तुओं के लिए दावा (claim for necessaries supplied to a person incompetent to contract)  
सेक्शन 69उस व्यक्ति की प्रतिपूर्ति जो किसी अन्य द्वारा शोध्य धन देता है  (reimbursement of money paid, due by another)  
सेक्शन 70अआनुग्रहिक कार्य का लाभ उठाने वाले व्यक्ति की बाध्यता  (obligation of person enjoying benefit of non-gratuitous act)  
सेक्शन 71पड़ा माल पाने वाले का दायित्व (responsibility of finder of goods)  
सेक्शन 72उस व्यक्ति का दायित्व जिसे भूल या प्रपीड़न द्वारा लाभ प्राप्त हुआ है (liability of a person getting benefit under mistake or coercion)  

किसी अन्य व्यक्ति द्वारा देय धन की अगर कोई अन्य व्यक्ति अदायगी कर दे तो क्या वह उसे उस व्यक्ति से वसूल सकता है? अगर हाँ, तो कानून के किस प्रावधान के तहत?

भारतीय संविदा अधिनियम के सेक्शन 69 के अनुसार अगर कोई व्यक्ति किसी ऐसे धन के लिए भुगतान करता है जिसे देने के लिए कोई अन्य व्यक्ति कानूनी रूप से दायित्व के अधीन है, तो वह अपने द्वारा दिए गए राशि की वसूली उस व्यक्ति से कर सकता है जो इस तरह देने के लिए कानूनी रुप से बाध्य था, भले ही उस व्यक्ति ने उसे ऐसा करने के लिए कहा हो या नहीं (अर्थात दोनों के बीच कोई कांट्रैक्ट नहीं हो)। लेकिन इसके लिए दो शर्ते है:

  1. देने वाले व्यक्ति का उसमे हित होना चाहिए, और
  2. अन्य व्यक्ति (जिसे वास्तव में देना था) उसे देने के लिए विधि द्वारा बाध्य हो।

किसी व्यक्ति ने किसी ऐसे लाभ को प्राप्त किया है जो आनुग्रहिक (gratuitous) नहीं था, और जिसके लिए कोई संविदा नहीं था, तो उस लाभ को लौटने के लिए उसका क्या दायित्व है?

अगर किसी व्यक्ति ने किसी अन्य व्यक्ति से कोई ऐसा लाभ प्राप्त कर लेता है जो उसे आशयित नहीं था अर्थात वह अन्य व्यक्ति उसे ऐसा कोई लाभ नहीं देना चाहता था तो यह विधिक सिद्धांत के अनुकूल होगा की उसे वह वापस करे।

कोई अन्य व्यक्ति किसी को कोई लाभ तभी देता है जब उससे उसे कुछ बदले में (प्रतिफल के रूप में) मिले (तब यह संविदा हो जाएगा) या वह किसी भी कारण से स्वेच्छा से उसे यह लाभ देना चाहे (जिसे आनुग्रहिक कार्य कहते है)। लेकिन अगर प्राप्त लाभ इन दोनों श्रेणी में नहीं आता है, जैसे किसी को भुलवश किसी अन्य की वस्तु दे देना, तो विधिक सिद्धांत यह है कि किसी एक व्यक्ति के हानि की कीमत पर किसी अन्य व्यक्ति को लाभ नहीं होना चाहिए, और इसलिए उस व्यक्ति को इस तरह प्राप्त लाभ लौटा देना चाहिए। यह सिद्धांत सेक्शन 70 में समाहित है।

सेक्शन 70 के अनुसार इस तरह हानि सहने वाला व्यक्ति उस की वसूली के लिए विधिक रूप से हकदार है, बशर्ते निम्नलिलखित शर्तें पूरी हो:

  1. वह कार्य या लेनदेन विधिपूर्ण हो,
  2. देने वाला व्यक्ति यह कार्य आनुग्रहिकतः नहीं करे,
  3. दूसरे व्यक्ति (प्रतिवादी) इस परिदान या देयता का लाभ उठाए;

जब ये तीनों शर्ते पूरी हो जाती है तो लाभ देने वाले व्यक्ति को प्रतिकार देने की लिए वह लाभ उठाने वाला व्यक्ति बाध्य हो जाता है।

यह सेक्शन अन्यायपूर्ण समृद्धि को रोकती है इसलिए यह व्यक्तियों से साथ सरकार और कार्पोरेशन पर भी लागू होता है क्योंकि यह लाभ संविदा के आधार पर नहीं बल्कि एक पक्षकार द्वारा दूसरे पक्षकार के लिए कुछ करने और दूसरे पक्षकार द्वारा उसके उपभोग करने पर आधारित है।

यदि एक बार किसी कार्य के लिए सेक्शन 70 के तहत देनदारी का दायित्व सरकार का उत्पन्न हो जाता है तो सरकार करार के दर पर देने के लिए बाध्य होती है, भले ही पक्षकारों के बीच विधिमान्य संविदा न हो।

लेकिन यह सेक्शन दो स्थितियों में लागू नहीं होता है:

  1. अगर लाभ प्राप्त करने वाला अवयस्क हो, अर्थात सेक्शन 70 अवयस्क के विरुद्ध प्रवर्तनीय नहीं है (section 70 cannot invoked against a minor) क्योंकि उसके लिए विनिर्दिष्ट उपबंध 68 है। साथ ही सेक्शन 70 के लिए स्वैच्छिक ग्रहण आवश्यक है लेकिन अवयस्क के मामले मे यह संभव नहीं हो सकता है।
  2. जब वादी द्वारा कोई सकारात्मक कार्य नहीं किया जाता है बल्कि कुछ करने से विरत रहा जाता है, तब भी यह धारा 70 के तहत दावा के लिए पर्याप्त नहीं है।

पड़ी वस्तु पाने वाले व्यक्ति (finder of lost goods) के अधिकार और दायित्व क्या हैं?

अगर किसी व्यक्ति को कोई ऐसी वस्तु मिले जिसका कोई मालिक नहीं हो (पड़ी वस्तु –lost goods) तो यद्यपि उसका उसके मालिक से कोई संविदा नहीं होता है लेकिन इस सेक्शन 71 द्वारा उसे उसी तरह का दायित्व दिया गया है जैसे उपनिधान (bailment) में होता है। बेलमेंट के अध्याय में सेक्शन 169 कुछ स्थितियों में ऐसे वस्तु को पाने वाले को उसे बेचने का अधिकार देता है।

पड़ी वस्तु पाने वाला कोई व्यक्ति उस वस्तु को कब बेच सकता है?

पड़ी हुई चीजों को पाने वाला सेक्शन 169 के तहत तभी उस वस्तु को बेच सकता है जब:

  1. युक्तियुक्त तत्परता के बावजूद उसके मालिक का पता नहीं चलता, या यदि मालिक मिल जाए तो वह उसका विधिपूर्ण प्रभार माँगे जाने पर देने से मना कर दे;
  2. उस वस्तु के नष्ट हो जाने या मूल्य समाप्त हो जाने का ख़तरा हो, या उसको रखने का खर्च उसके मूल्य के दो-तिहाई हो जाए;

अगर इन शर्तों के पूरा नहीं होने पर भी पाने वाला व्यक्ति उस वस्तु को बेच दे तो वह संपरिवर्तन के लिए उत्तरदायी ठहराया जा सकता है।

पड़ा हुआ माल पाने वाले व्यक्ति के धारणाधिकार और प्रतिकार के अधिकार (finder’s right of lien and compensation) क्या हैं?

अगर किसी व्यक्ति को कोई वस्तु पड़ी हुई मिले जिसका कोई मालिक न हो तो उस वस्तु को रखने और उसके मालिक को खोजने में जो खर्च उसे होता है उसके लिए वह वस्तु के मालिक पर प्रतिकार के लिए कोई वाद नहीं ला सकता है। लेकिन उसे यह अधिकार है कि:

  1. वह उस वस्तु को तब तक रोक कर रख सकता है जब तक कि उसे अपने खर्च के लिए प्रतिकार प्राप्त नहीं हो जाता है।
  2. यदि मालिक ने कोई इनाम रखा हो तो उसे पाने तक वह इसे रख सकता है। विनिर्दिष्ट इनाम घोषित होने पर इसके लिए वह न्यायालय में वाद ला सकता है।
  3. यदि ऐसा कोई इनाम नहीं रखा हो फिर भी मालिक ने उसे कुछ देने का वचन दिया हो तो उसे पाने तक वह इस रख सकता है। इसके लिए वह सेक्शन 25 (2) के तहत वाद ला सकता है।

पड़ी हुई (खोई हुई) वस्तु पाने वाले कि विधिक स्थिति उपनिहिती (bailee) की तरह होता है उसका अधिकार उस वस्तु के वास्तविक स्वामी को छोडकर प्रत्येक व्यक्ति से बेहतर होता है (finder is bailee only against the true owner)। इसलिए इस तरह की वस्तु पाने वाले कोई व्यक्ति अगर किसी सुनार को इसकी कीमत लगाने के लिए देता है तो उसे वह सुनार से वसूल सकता है (आरमरी बनाम डेलामिरी– (1721) 1 स्ट्रा. 505) ।

उस व्यक्ति का क्या दायित्व है जिसे भूल या प्रपीड़न द्वारा कोई लाभ प्राप्त हुआ है (liability of a person getting benefit under mistake or coercion)?

सेक्शन 72 उस स्थिति के लिए उपबंध करता है जब भूल के अधीन किसी ने कोई अन्यायपूर्ण लाभ (unjust benefit under mistake) उठाया है। यह सेक्शन केवल तथ्य की भूल पर ही लागू नहीं होती बल्कि विधि की भूल पर भी लागू होती है (सेल्स टैक्स ऑफिसर, बनारस बनाम कन्हैया लाल – AIR 1959 SC 135)।

 इस सेक्शन के तहत वाद लाने के लिए परिसीमा की अवधि भारतीय परिसीमा अधिनियम (the Indian Limitation Act, 1963) के अनुच्छेद 113 के द्वारा तीन वर्ष निर्धारित किया गया है।

लेकिन इसके तहत तब दावा नहीं किया जा सकता है जब वादी ने स्वयं भुगतान नहीं किया हो। उदाहरण के लिए वादी ने भुलवाश उत्पाद शुल्क का भुगतान कर दिया। उसने यह राशि अपने ग्राहकों से वसूल ली। कोर्ट ने पाया कि चूँकि यह राशि वादी की जेब से नहीं गया था, इसलिए वे प्रतिदाय (refund) के हकदार नहीं थे (रोपलास (इंडिया) लि. बनाम यूनियन ऑफ इंडिया – AIR 1989 Bom 183) 

वादी तब भी इसे नहीं वसूल सकता जब कि प्रतिवादी को अन्यायपूर्ण समृद्धि नहीं हुआ हो। अगर प्रतिवादी ने समान भूल के कारण वह संपत्ति किसी और को दे दिया तो उसके लिए वह वादी के प्रति उत्तरदायी नहीं होगा।

उदाहरण के लिए A द्वारा B को यह कहने पर कि उसने एक मनीऑर्डर प्राप्त करने के लिए उसका पता दिया है, B ने वह मनीऑर्डर लेकर A को दे दिया। बाद में पता चला कि वह मनीऑर्डर जाली था। A को सजा दी गई। लेकिन पोस्ट ऑफिस द्वारा यह राशि B, जिसे भूलवश दिया गया था, से वसूलना विधिमान्य नहीं हुआ।

कोर्ट के अनुसार जिस तरह भुलवश पोस्ट ऑफिस ने B को मनी ऑर्डर दिया उसी तरह उसी भुलवश B ने उसे A को दे दिया। इससे उसे कोई समृद्धि (enrichment) नहीं हुई। अतः उसका कोई दायित्व नहीं था (नागोराव बनाम गवर्नर जनरल इन काउंसिल – AIR 1951 Nagpur 372)।

सेक्शन 72 भूल के साथ ही प्रपीड़न के अधीन दिए गए धन को वापस वसूलने की अनुमति देता है। लेकिन न्यायालयों ने पाया है कि इस सेक्शन में प्रयुक्त प्रपीड़न शब्द सेक्शन 15 में परभाषित अर्थ से भिन्न और विस्तृत है जैसा कि इसके दृष्टांत (ख) से स्पष्ट होता है (सेठ कन्हैया लाल बनाम नेशनल बैंक ऑफ इंडिया– (1913) 40 A 56 PC)।

इसमे इस शब्द का प्रयोग साधारण अर्थों में किया गया है “किसी व्यक्ति द्वारा किसी करार को कारित करवाने के आशय” के लिए नहीं। लेकिन यह आवश्यक है कि वह राशि अविधिपूर्ण हो और वादी द्वारा विवशतावश दिया गया हो।
